1. CANCELLATIONS & RESCHEDULING
The Client understands that the Photographer reserves a specific date and time exclusively for the Client.
If the Client needs to cancel or reschedule, reasonable notice is requested. Rescheduling is subject to Photographer availability.
The Photographer will retain a non-refundable fee of $50.00 to be transferred to a future session if a cancellation is to occur.
For outdoor sessions, the Photographer may recommend rescheduling due to severe weather, unsafe conditions, or circumstances that could negatively affect the safety of the Client, Photographer, equipment, or photographic results.
2. PHOTOGRAPHER LIABILITY & ASSUMPTION OF RISK
The Client understands that photography sessions may take place in studios, private properties, public locations, parks, beaches, trails, outdoor environments, or other locations where ordinary risks may be present.
The Client voluntarily assumes responsibility for their own safety and the safety of any children or other individuals accompanying them during the session.
The Photographer will take reasonable precautions to provide a safe photography environment; however, the Photographer cannot guarantee that accidents, injuries, property damage, weather-related incidents, or other unforeseen circumstances will not occur.
To the fullest extent permitted by applicable Washington law, the Client agrees that the Photographer shall not be responsible for injuries, losses, damages, delays, or other incidents arising from circumstances outside the Photographer’s reasonable control.
The Photographer shall not be responsible for circumstances caused by the Client or other participants, including failure to follow reasonable instructions, unsafe conduct, undisclosed medical or physical limitations, or hazards inherent to the selected location.
Nothing in this Agreement is intended to waive or limit liability that cannot legally be waived or limited under Washington law.
3. PHOTOGRAPHY STYLE & CLIENT EXPECTATIONS
The Client acknowledges that they have reviewed the Photographer’s portfolio and understand the Photographer’s artistic style.
The Photographer will use professional judgment regarding composition, lighting, posing, editing, image selection, and artistic presentation.
The Photographer does not guarantee a specific number of photographs, poses, expressions, or photographic results.
The Photographer will make reasonable efforts to accommodate Client requests and ideas; however, the final artistic interpretation remains the Photographer’s creative decision.
4. IMAGE SELECTION & DELIVERY
The Photographer will select and professionally edit the final images from the session.
Unless otherwise stated in writing, the Client will not receive every photograph taken during the session. Unedited, rejected, duplicate, test, blurry, or otherwise unusable photographs are not considered deliverable images.The Photographer will complete the editing and preparation of the final photographs
within approximately two (2) weeks following the photography session
, unless otherwise communicated to the Client.
Unforeseen circumstances, illness, emergencies, equipment failure, unusually large sessions, or circumstances outside the Photographer’s reasonable control may occasionally require additional processing time. The Photographer will communicate with the Client if a significant delay is anticipated.
Payment in full is required before final photographs are released to the Client.
5. COPYRIGHT & OWNERSHIP
The Photographer retains all copyrights and intellectual property rights to all photographs created during the session, as provided under applicable copyright law.
Payment for photography services does
not
transfer copyright ownership to the Client.
The Client receives a personal-use license to use the delivered photographs for their own personal purposes, subject to the terms of this Agreement.
The Client may not sell, license, commercially distribute, substantially alter, manipulate, filter, edit, retouch, or otherwise modify the Photographer’s photographs without the Photographer’s prior written permission.
This includes, but is not limited to:
Applying filters or presets
Altering colors or skin tones
Cropping in a manner that materially changes the composition
Adding graphics or text directly to the photograph
Removing the Photographer’s watermark or identifying information
Applying AI-generated alterations or enhancements
Submitting altered versions for publication or contests
Selling or licensing the photographs to another person or business
The Client may request additional edits from the Photographer, which may be subject to an additional fee.
6. PERSONAL USE
Unless otherwise agreed in writing, the Client may use the delivered photographs for personal, non-commercial purposes, including:
Personal social media
Personal websites
Family albums
Personal prints
Gifts
Personal announcements
Sharing with friends and family
The Client agrees to provide reasonable attribution to the Photographer when practical when sharing images publicly.
7. MINORS
If photographs include a minor under the age of 18, the signing parent or legal guardian confirms that they have the legal authority to provide consent for the minor’s participation in the session.
The parent or legal guardian is responsible for supervising minors during the session unless otherwise agreed.
The Photographer reserves the right to stop or modify a pose, activity, or photographic setup if the Photographer reasonably believes it presents an unsafe situation.
8. LOCATION & PROPERTY
The Client is responsible for obtaining any necessary permission, reservation, permit, entrance fee, or property authorization required for a location selected by the Client.
Any location fees, admission fees, parking fees, permits, travel fees, or other location-related expenses may be the responsibility of the Client unless otherwise agreed in writing.
The Client agrees to respect the rules and property of the selected location.
9. CLIENT COOPERATION
The Client agrees to cooperate reasonably with the Photographer and follow reasonable instructions regarding posing, positioning, movement, safety, and use of the photographic location.
The Photographer is not responsible for missed photographic opportunities resulting from Client lateness, failure to cooperate, inappropriate conduct, or circumstances outside the Photographer’s control.
10. IMAGE STORAGE
The Photographer will make reasonable efforts to maintain backup copies of delivered photographs for a limited period following delivery.
The Client is responsible for downloading and safely storing their final photographs after delivery.
The Photographer is not required to permanently archive photographs indefinitely.
11. PRINTS & PRODUCTS
Digital photographs included with the Client’s package are provided according to the specific package purchased.
Professional prints, albums, canvas, metal prints, wall art, specialty products, and other physical products may be purchased separately.
Color, brightness, contrast, and appearance may vary between computer screens, mobile devices, and physical printing materials.
The Photographer is not responsible for quality issues resulting from photographs printed by third-party consumer printing services.
12. FORCE MAJEURE / UNFORESEEN CIRCUMSTANCES
The Photographer will not be considered in breach of this Agreement for failure or delay in performing services due to circumstances beyond reasonable control, including but not limited to severe weather, natural disasters, illness, injury, emergencies, government restrictions, equipment failure, venue closure, or other unforeseeable circumstances.
If the Photographer is unable to complete the session due to such circumstances, the parties will make reasonable efforts to reschedule the session.
If rescheduling is not reasonably possible, any refund or credit will be handled according to the circumstances and applicable provisions of this Agreement.
13. EXCLUSIVE PHOTOGRAPHER
Unless otherwise agreed, the Photographer will serve as the primary professional photographer during the session.
Guests and other individuals may take photographs for personal use, provided they do not interfere with the Photographer’s work, equipment, lighting, posing, or ability to perform the contracted services.
14. AGREEMENT & CHANGES
This Agreement represents the understanding between the Photographer and Client regarding the photography services described above.
Any changes or additions to this Agreement should be made in writing and agreed upon by both parties.
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in effect to the extent permitted by law.
This Agreement shall be interpreted under the laws of the State of Washington.
15. PHOTOGRAPHIC IMAGE USE & PROMOTIONAL CONSENT
The Client grants the Photographer permission to use images from the photography session for professional and promotional purposes, including but not limited to
photography contests and competitions, social media, website galleries, portfolios, advertising, marketing materials, publications, promotional materials, and other business-related purposes.
The Photographer may use selected images at their professional discretion. No additional compensation will be provided to the Client for the use of images under this agreement.
CLIENT ACKNOWLEDGMENT
By signing below, the Client confirms that they have read, understood, and agree to the terms of this Photography Services Agreement.
The Client understands that:
Payment in full is required before final photographs are released.
The Photographer retains copyright ownership of all photographs.
The Client may not substantially alter, manipulate, or commercially use the photographs without permission.
Final photographs are expected to be completed within approximately two weeks following the session.
The Photographer does not guarantee a specific number of photographs.
The Client has had an opportunity to ask questions regarding this Agreement.
Electronic Signature & Agreement By typing your full legal name below, you acknowledge that you have read, understand, and voluntarily agree to the terms and conditions outlined in this Photography Agreement.
